The short answer

The short answerA trademark application needs four things: the mark itself (the word, or the logo as a clear image), the applicant's name and address exactly as on the PAN or incorporation certificate, the list of goods or services, and a signed authorisation in Form TM-48. A Udyam or DPIIT certificate halves the government fee.

Which documents do you need for Trademark Registration?

For every applicant

  • The mark: the word, or the logo as a clear JPEGClear JPEG or PNG of the mark alone on a plain background.

Why do applications get rejected?

  1. Applicant name differs from the PAN or incorporation certificate

    'ABC Tech' on the form and 'ABC Technologies Private Limited' on the certificate is a mismatch that invites an objection and a correction request.

  2. Logo uploaded as a low-resolution or cropped image

    The registry needs a clear JPEG of the mark. A screenshot with a background or a watermark gets a formality check failure.

  3. Goods or services listed in the wrong class

    A software product filed in class 35 (retail) instead of class 9 or 42 leaves the actual product unprotected. We map the classes from what you sell.

  4. TM-48 not signed or dated

    The authorisation lets us file on your behalf. An unsigned form stops the filing until it is corrected.

  5. Prior use claimed without evidence

    A first-use date needs an affidavit and dated proof such as invoices or ads. Claiming use without them risks an objection.

Questions founders ask about Trademark documents

What format should the logo be in?

A clear JPEG or PNG of the mark alone, on a plain background, at a size where every letter is legible. If you want the logo protected in colour, submit the colour version; a black and white filing covers all colours. Send the word mark as plain text.

Which name goes on the application?

The legal owner of the brand: you as an individual, or the company or LLP exactly as named on its incorporation certificate, with the registered office address. Founders often file in their own name before incorporation and assign the mark to the company later, which is allowed.

What proves I qualify for the lower government fee?

The Udyam registration certificate for an MSME or the DPIIT recognition certificate for a startup, uploaded with the application. An individual applicant needs nothing extra. Without a certificate the ₹9,000 rate applies even to a one-person company.

What is Form TM-48?

The power of attorney that authorises us to file and prosecute the application on your behalf. We prepare it; you sign it (digitally or on paper and scanned). It is filed with the application and covers the examination reply and hearings.

Do I need proof that I am already using the brand?

Only if you claim a first-use date rather than filing as 'proposed to be used'. Prior use strengthens the application against similar marks, and needs a user affidavit plus dated evidence: invoices, packaging, website archives or ads showing the mark.
