How to file a trademark abroad from India
The steps update with the countries you pick.
Have your Indian mark in place
Madrid needs a base mark in India in the same name: a pending application or a registration. The international mark must be identical and cover the same or fewer goods and services.
Filing within 6 months of the Indian application lets you claim its date as priority in every country.
Prepare the international application
Form MM2(E), in English. It lists the countries, classes and goods, copied from or narrower than your Indian mark.
File online with IP India
Filed through IP India's international application system only. IP India charges a government handling fee of ₹5,000 to certify and forward it.
IP India certifies and forwards to WIPO
The Registry checks the application against your Indian mark. If WIPO receives it within 2 months, your international registration takes the date IP India received it.
Pay WIPO in Swiss francs
IP India's alert tells you the amount. Pay WIPO directly by card or bank transfer. If anything is missing or short, WIPO sends an irregularity notice with 3 months to fix it.

WIPO checks formalities, records the international registration, publishes it in the WIPO Gazette, sends you the certificate and notifies every country you picked.
Each country examines under its own law
The clock starts when WIPO notifies the office. Silence until the window closes means the mark is protected there.
Each office has 12 or 18 months, depending on the country.
Answer any objection through a local agent
An objection, called a provisional refusal, goes to the national office, usually through a local attorney. Their fees are not government fees and are not in this estimate.
None of your picks has an unusually short reply window. Most give 2 to 6 months.
Five years tied to the Indian mark
For 5 years the international registration depends on your Indian mark. If the Indian mark is refused, withdrawn or cancelled in that time, protection abroad falls with it. You then have 3 months to turn each country into a national application that keeps the original date.

- Yes, from the first refusal onward. A foreign-domiciled holder must be represented by a US-licensed attorney before the USPTO. Not needed at filing, since WIPO forms cannot name one.
- Reply deadline
- 6 months from the USPTO issue date of the refusal (the date it goes to WIPO), with no extension. Refusals based on opposition: answer due 40 days from the TTAB order setting dates.
- At filing
- Form MM18 annex: signed declaration of bona fide intention to use the mark in US commerce, filed with the MM2 or subsequent designation.
- Legal nature of the holder and the state or country under whose laws it is organised (for an Indian company, e.g. private limited company, India). Individuals give citizenship.
- Goods/services worded to USPTO ID Manual standards. Class headings and broad terms (e.g. 'clothing') are refused. No brackets or parentheses.
- Description of the mark if it is not in standard characters, plus a colour claim naming each colour and where it appears.
- Translation of any non-English wording and transliteration of non-Latin characters (e.g. Hindi or Gujarati script).
- After protection
- Section 71 declaration of use with specimen (or excusable non-use) between years 5 and 6 after the US registration date. 6-month grace period with a fee.
- Section 71 again between years 9 and 10 and every 10 years after that. Renew the IR at WIPO at the same time. Missing either cancels US protection.
- Delete goods no longer in use (Section 7). Non-use exposes the registration to expungement or reexamination.
Open to cancellation after 3 years of non-use.
- Examination
- Full ex officio examination on absolute and relative grounds (earlier US registrations and applications).
- Approved marks are published in the Official Gazette. 30-day opposition period, extendable up to 6 months from publication.
- Principal Register only. The USPTO registers the extension of protection, issues a US registration certificate and sends a statement of grant to WIPO.
- Typical timeline
- USPTO targets: first action about 5 months after filing and average total pendency of 11 to 14 months (all applications, not Madrid-specific).
- Watch out for
- Draft the goods list for the US before filing. The IR cannot be broadened later, so vague terms usually force deletions.
- Section 71 deadlines run from the US registration date, not the IR date. Diarise them separately from WIPO renewals.
- Budget for a US attorney as soon as any office action arrives, because the 6-month deadline cannot be extended.

- Second language is compulsory for an EU designation: French, German, Italian or Spanish when filing in English (MM2 item 11).
- Optional seniority claim for earlier marks registered in or for EU member states on Form MM17, one form per member state.
- Optional EU search report and national search reports must be requested from EUIPO within 1 month of WIPO's notification (Art. 195 EUTMR).

- Absolute grounds and classification examined ex officio; relative grounds only on opposition.
- Opposition period: 3 months, starting 1 month after EUIPO republishes the IR (Art. 196(2) EUTMR).
- With no refusal or opposition the statement of grant is sent automatically. If a partial refusal is not answered, only the refused goods are lost.
- Watch out for
- Unitary right: one earlier right in any single member state can defeat the whole EU designation through opposition.
- If refused, the EU designation can be converted into national designations or national filings keeping the IR date (Art. 202 EUTMR).
- Does not cover Norway, Switzerland, Iceland, Liechtenstein, UK, Jersey or Guernsey; designate them separately.

- No UK-specific MM2 items. A UK designation also covers Gibraltar and the Isle of Man (MM2 footnote, WIPO Info Notice 77/2020).

- No declarations of use.
- 5-year non-use period runs from the date UK protection is completed, not the IR date.
- No UK certificate is issued; a protected IR(UK) is treated as a UK registered trade mark.

- Examination
- Absolute grounds examined ex officio. UKIPO searches earlier UK marks and reports them for information only; no ex officio relative refusal.
- Accepted IRs are published in the Trade Marks Journal; opposition period 2 months, extendable to 3 by filing Form TM7A.
- Protection arises the day after the opposition period ends if unopposed; UKIPO issues a Rule 18ter statement of grant.
- Watch out for
- Since 1 Aug 2026 a UK designation no longer covers Jersey; designate JE separately (WIPO Info Notice 31/2026).
- Guernsey has been a separate designation since 1 Jan 2021; Gibraltar and the Isle of Man are still covered by GB.
- Record a UK address for service early so opposition papers are not missed (UKIPO practice since TPN 2/2023).

- No Arabic translation needed at filing via Madrid (English, French or Spanish); later local documents generally need certified Arabic translations.
- Goods barred nationally on public-policy grounds are refused for IRs too (DLA Piper 2022); pork (cl 29) and bar services (cl 43) listed as excluded (Country Index).
- Class 33 alcoholic beverages accepted for national filings since 15 Sep 2026 (practice change, Withers); handling for IRs not yet confirmed.

What to know before you file abroad
When the Madrid route works best
- You want protection in three or more countries, especially where country fees are modest.
- Your Indian trademark is registered, or pending with no objection or opposition.
- You expect to add countries over time. Adding them later costs ₹34,926 (CHF 300) plus each country's fee.
- You want one renewal date and one place to record a change of name, address or owner.
When a national filing is better
- The market is not a Madrid member, such as Hong Kong, Taiwan, Bangladesh, Sri Lanka, Kuwait, Nigeria or South Africa.
- Your Indian application faces an objection or opposition, which puts every country at risk for five years.
- You need wider goods and services, or a local-language version of the mark, that your Indian filing does not cover.
- You need only one or two countries and will hire local counsel there anyway.
Rules that catch people out
- Five years tied to India. If the Indian mark falls in the first five years, every country falls with it. You then have three months to convert each country into a national application.
- No broadening later. Goods and services can be narrowed after filing, never widened.
- Fees move with the franc. WIPO revises country fees when exchange rates shift, and the rupee cost moves with the CHF rate.
- Local agents for objections. If a country objects, you reply to that country's office, usually through a local attorney.
- Use filings. The US, the Philippines, Mexico and Cambodia need local declarations of use to keep protection.
- Lookalike invoices. Owners receive official-looking payment requests from private firms. Pay only WIPO, IP India or your own agent.

- Professional fees for preparing and filing the application.
- Local agent fees if a country objects or a third party opposes.
- Translation, notarisation and legalisation of documents.
- Bank charges and the forex markup on paying in Swiss francs.
- Local registration certificates that some offices issue on request.

What is WIPO?
WIPO, the World Intellectual Property Organization, is the United Nations agency in Geneva that runs the Madrid System for international trademarks. It records your international registration, publishes it in the WIPO Gazette and sends it to each country you choose. WIPO sets its fees in Swiss francs.
What is the Madrid Protocol?
The Madrid Protocol is the treaty behind the Madrid System. It lets an Indian business file one application in English through IP India and ask for trademark protection in any of the other member countries. As of 8 October 2026 it has 117 members covering 133 countries.
How much does it cost to register a trademark internationally from India?
Government fees have three parts: IP India's handling fee of ₹5,000, WIPO's basic fee of ₹76,022 (CHF 653), or ₹1,05,127 (CHF 903) for a colour mark, and a fee for each country. Country fees run from ₹4,773 (CHF 41) in Laos to ₹1,65,316 (CHF 1,420) per class in the UAE. For the US, EU, UK, UAE and Singapore in one class, government fees total about ₹4,50,538.
How much does a US trademark cost from India through the Madrid Protocol?
The United States charges ₹53,553 (CHF 460) per class. Add WIPO's basic fee of ₹76,022 (CHF 653) and IP India's ₹5,000, and one class comes to about ₹1,34,575 in government fees. The US also needs Form MM18 at filing and a declaration of use between the fifth and sixth year after registration.
How much does it cost to register a trademark in the UAE or Dubai from India?
The UAE charges ₹1,65,316 (CHF 1,420) per class, one of the highest fees in the Madrid System. With WIPO's basic fee and IP India's ₹5,000, one class costs about ₹2,46,338 in government fees. A UAE designation covers all seven emirates, including Dubai.
Which countries are covered by the Madrid Protocol?
The Madrid System has 117 members covering 133 countries, including the United States, the European Union, the United Kingdom, the UAE, Saudi Arabia, Singapore, China, Japan, Australia and Canada. One EU designation covers all 27 EU states and one OAPI designation covers 17 African states. From India you can choose from 119 designations.
Which countries are not covered by the Madrid Protocol?
Hong Kong, Macao, Taiwan, Bangladesh, Sri Lanka, Nepal, Kuwait, Jordan, Nigeria, South Africa, Argentina and Peru are among the markets outside the Madrid System. For these you file a separate national application in each country.
Do I need an Indian trademark before filing internationally?
Yes. A Madrid application from India must be based on an Indian trademark application or registration in the same name. The international mark must be identical, and it can cover the same or fewer goods and services.
How long does international trademark registration take?
IP India certifies the application and forwards it to WIPO, which records the international registration. Each country then has 12 or 18 months to object, and if it does not, the mark is protected there. Many offices confirm protection sooner, but plan for up to about 20 months from filing.
What documents do I need to file a Madrid application from India?
You need the details of your Indian application or registration, the exact mark image, a goods and services list within your Indian specification, applicant details that match the Indian record, proof that you can file from India, and Form TM-48 if an agent files for you. Some countries add their own items, such as Form MM18 for the United States.
What happens if my Indian trademark is refused or cancelled?
For five years from the international registration date, every country depends on your Indian mark. If the Indian mark is refused, withdrawn or cancelled in that time, protection abroad falls with it. You then have three months to convert each country into a national application that keeps the original date.
Can I add more countries later?
Yes. A subsequent designation adds countries to an existing international registration for a WIPO basic fee of ₹34,926 (CHF 300) plus each country's fee. Protection in the new countries ends with the international registration, so everything renews together.
Why are the fees in Swiss francs, and how are the rupee amounts worked out?
WIPO and its member offices fix Madrid fees in Swiss francs. This calculator converts them at ₹116.42 per franc, the mid-market rate on 10 October 2026, and you can enter your own rate. Banks and card issuers add a markup, and WIPO's fee table on your filing date decides the amount you pay.
Are these the full costs of filing a trademark abroad?
No. Every amount here is a government fee: IP India's handling fee and WIPO's fees, including each country's own fee. Professional fees, local agent fees if a country objects, translations and bank charges are extra.
